By consent Civil Application No.3685 of 2017 is allowed in terms of prayer clauses (a) to(c). On the basis of this order, amendment shall be carried out to the Memorandum of Appeal and the Memorandum of Cross Objection within a period of two weeks from the date on which this order is uploaded.
The consent terms in Appeal are tendered on record. The same are taken on record and marked `X-1' for identification. The consent terms bear the signature of Shri D.N.Bhadakawad, Sub Divisional Officer, Karjat who is duly authorised by the State Government. The consent terms are also signed by the Advocate for the
ssp fa2151withxobst642withca respondents and the learned Addl.G.P for the State. The consent terms bear the signatures of Respondent No.1b, 1c, 1d, 2, 3, 4a, 4a-2, 4a-3,4a-4,4b and 4c. Rest of the respondents have affixed their left hand thumb impression. The respondent No.3 who is also respondent No.4c is personally present in the Court who states that the contents of the consent terms are correct. He further states that all other respondents have accepted the contents of the consent terms to be correct. Accordingly, the appeal and the cross objection stand disposed in terms of the consent terms. Consent Award be drawn accordingly.
Indemnity bond and the bank guarantee, if any, furnished by the respondents in terms of the order dated 30th June 2006 in Civil Application No.5327 of 2005 be cancelled and returned to the respondents. All pending civil applications stand disposed of.
