By this application, applicant who is convicted by the learned Sessions Judge, Vasai for the offence punishable u/s.489C of IPC has prayed for suspension of sentence and for bail. Learned counsel for the applicant has contended that applicant was on bail, pending trial, applicant on no occasion has misused liberty granted to him.

It is further submitted that applicant is convicted for a period of five years for the offence punishable u/s.489C IPC which is a bailable offence and thus, prayed that application be allowed.

Tilak 2/2 (14)APPA-1190-16 Record reveals that applicant came to be convicted for the offence punishable u/s.489C and is sentenced to suffer RI for 5 years and to pay fine of Rs.10,000/- in default to suffer RI for six months.

Considering the sentence imposed, as aforesaid, as it can be termed to be short sentence and since applicant was on bail, pending trial, application is allowed as per order below.

O R D E R

(i) Applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.20,000/- with one surety in like amount.

(ii) On being released on bail, applicant shall mark his presence with Nalasopara Police Station once in three months on first day of each such month.

(iii) Applicant shall provide proof of his residential address, and shall update the same with the Investigating Officer if there is change in his residence in future.
