This petition challenges the order dtd. 7th August, 2014, by which the Civil Judge, Senior Division, Kalyan awarded maintenance @Rs.3,000/- per month to the respondent-wife alongwith the legal expenses of Rs.10,000/-. The petitioner claims that since the respondent is already working as Sales Co-ordinator with the Company by name Wings Bizpro (Interface), Mumbai and earning Rs.19,000/- approximately, she will not be entitled for any maintenance from the petitioner. According to the petitioner, his own monthly income is of Rs.15,500/- as an employee of a private company at Kolkata. As

Dusane 2/2 WP10256.2014 against this, the respondent alleges that the monthly income of the petitioner is more than Rs.1,00,000/-. The trial court has noted that the documents produced show that he used to travel by Air and his standard of living is much higher than that of the respondent. He has a flat admeasuring 1000 sq. ft. at Ambernath and house property at Calcutta. He also owns a four wheeler. Considering these aspects, in my opinion, the trial court has correctly assessed the income of the parties and granted a small amount of maintenance of Rs.3,000/- per month to the respondent.
