By a reasoned order dated 15.09.2017, the Applicants were granted interim relief and were directed to attend the Investigating Officer on stipulated dates to join the process of investigation. By subsequent orders, the Applicants were further directed to attend the Investigating Officer on stipulated dates and to join the process of investigation.
Perused the record of investigation. The record indicates that though the Applicants attended the Investigating Officer on several occasions, the Investigating Officer did not bother to effect the recovery of laptops which are alleged to have been used by the Applicants in the present crime. The record further indicates that the Applicants had left the job of "Quosphere Infosolution Private Limited" approximately six months prior to the registration of the first Sneha Chavan 1/2
14 aba 1626-17=.doc information report and it appears that ,there is substance in the submission of the learned Counsel for the Applicants that, as the Applicants left the job of the said company for their better prospects, the said company has lodged the present crime. It further prima facie appears that first informant company has not suffered any loss in the present crime.
In view of the above, interim relief granted by an Order dated 15.09.2017 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
