The Applicant is protected by Order dated 30th November, 2021. The Applicant was directed to be released on bail on furnishing P.R. bond and solvent surety in the sum of Rs.20,000/- with one or two sureties. He was directed to make himself available for interrogation by a police officer of the concerned police station as and when required. Today this Court specifically asked learned APP as to

2 3-ABA-2795-2021.doc whether the Applicant was called to police station for interrogation. On instructions, learned APP submits that the Applicant was not called to police for interrogation. Coming to the merits, it is seen that the allegation against the Applicant that he used to take amount from the persons in need of a Ration Card. It is aleged that on taking the amount he used to issue bogus Ration Card to such persons. The amount charge was Rs.1200/- for one Ration Card. Looking to the fact that the offence is registered on 07th January, 2020 and till today Applicant was not even called for interrogation shows that his custody is not required. Hence the following order.

ORDER

(a) The Application stand allowed.

(b) The Applicant be released on bail in the event of his arrest in connection with the FIR No.0006 dated 07/01/2020 registered with Nigdi Police Station, Pimpri Chinchwad in connection with the offences punishable under Sections 406, 420 & 468 of the Indian Penal Code on furnishing

(c) He shall attend the Police Station as and when require by the police for the purpose of investigation.

(d) Application stands disposed of.
