Heard learned Counsel for the parties.

By this application, the applicants seek pre-arrest bail in connection with C.R. No.I-83 of 2017 registered with the Turbhe MIDC Police Station, for the alleged offences punishable under Sections 406, 409 r/w 34 of the Indian Penal Code.

Perused the papers. The applicant No.1 is the Managing Director of Pranav Constructions Private Limited and applicant No.2 is the Director of the said Company. According to the complainant, Assistant Commissioner of Provident Fund (P.F.) - Mr.Ashish Tripathi, the applicants had failed to deposit employees provident fund amount of Rs.8,96,609/-. It appears that after the registration of the aforesaid FIR, the applicants have deposited the employees provident fund amount of Rs.8,96,609/-. The said fact is not disputed by learned APP.

In view of the aforesaid, the custodial interrogation of the applicants is not necessary. Accordingly, the application is allowed and the applicants are granted pre-arrest bail on the following terms and conditions :
ORDER
(i) In the event of the arrest, the applicants be enlarged on bail on executing P.R. Bond in the sum of Rs.15,000/- each with one or two sureties in the like amount.

The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear, that the observations made herein are prima facie and are confined to this application.
