The learned counsel for the appellant submits that, the respondents/claimants filed an execution application. Hence there is an urgency.

Advocate for appellant submits that by this First Appeal they th April 2019 are challenging the Judgment and Award dated 20 passed by Motor Accident Claims Tribunal, Pune, at Pune in Motor Accident Claim Petition No. 318 of 2016 holding that the respondents/claimant is entitled sum of Rs. 31,11,300/- by way of compensation with interest @ 8% per annum from the date of petition till the date of realization.

Considering the submission made by the learned counsel for appellant and impugned Judgment and award, I am satisfied that the appellant has made out a case for following order.

ORDER

a) Admit.

b) Printing is dispensed with.

c) Appellant to file private paper book within one year from today, failing which First Appeal shall stand dismissed without further reference to the Court.

d) Registry is directed to call Record and Proceeding immediately.

e) Service on respondent No.2 is dispensed with at the cost and consequences of the appellant.
