The learned Counsel for the applicant submits that by this Civil Application they are seeking condonation of 334 days delay in filing present Civil Application and restoration of Appeal from Order No.194 of 2008 which stands dismissed by order dated 07.10.2008.

The learned Counsel for the applicant submits that during the pendency of the present Civil Application, the Special Civil Suit No.578 of 2007 stands disposed of by order dated 09.01.2017. Hence, in view of subsequent development, nothing survives in the present Civil Application.

Hence, Civil Application stands disposed of as infructuous.
