In our view, there is no error apparent on the face of the record. It is clear that our judgment on the review relies on and follows the decision of the Supreme Court in M Ramanatha Pillai v The State of Kerala & Anr.1 The submission that there is a another judgment of this Court that distinguishes the High Court decision in (1973) 2 SCC 650.
