The challenge in this Appeal, is to the order dated 4 November 2021, passed by the learned City Civil Court in Stamp No.7773 of 2021 by which, the ad-interim relief has been rejected.

The learned counsel for the Private Respondents states that a reply is filed as well as written statement is also filed in the Civil Suit.

The learned counsel for the Appellant as well as the learned counsel appearing for the Private Respondents, submit that the hearing of the Notice of Motion may be expedited. 4.

In that view of the matter, the Appeal is disposed of in the following terms.

ORDER

(i) It will be open to such of the Defendants who have not filed a reply to file the same within a period of three weeks from today.

(ii) The City Civil Court shall hear and decide the matter of interim relief sought by the AppellantPlaintiff as expeditiously as possible and preferably within a period of three months from the filing of the reply.

(iii) The parties to co-operate for the time bound disposal of the matter.

(iv) The rival contentions of the parties are left open.

(v) There shall be no order as to costs.

The pending Interim Application, if any, stands disposed of.
