Heard learned counsel for the applicant and the learned APP for the respondent - State. 2.

By this application, the applicant seeks relaxation/modification of the order dtd. 09.10.2012 passed in B.A.No.1895 of 2011 by this Court (CORAM : SMT.R.P.SONDURBALDOTA,J.). The condition of which relaxation/modification is sought reads as under:-

"3. The applicant shall not leave India without the previous permission of the Court."

Learned counsel for the applicant states that the applicant intends to travel to China from 18.10.2015 to 01.11.2015 to attend the farewell ceremony of his daughter, who is in China.

For the reasons set out in the application, the Cri. Appln.No.838 of 2015 is allowed and the condition is modified to the extent that the applicant is permitted to travel to China from 18.10.2015 to 01.11.2015.

Accordingly, the Application is disposed of.
