Considering the nature of accusations faced by the applicant and since the C.R. invokes sections 406 and 420 of IPC. The learned APP make a statement that the Investigating Officer shall issue notice to the applicant on the address mentioned in the title clause within a period of three weeks from today.

The counsel for the applicant state that the address mentioned in the title clause, is the address, where he is presently residing. Upon receipt of such notice, the Investigating Officer shall follow procedure prescribed under Section 41A of the Cr.P.C. and Ashish Mhaske

2/2 905 ABA 2654.22.doc record reasons in case, he comes to a conclusion that custodial interrogation of the Applicant is necessary for completing the investigation. He shall also issue 72 hours notice in advance in case if he is desirous of effecting the arrest.

The counsel for the applicant also make a statement that he is ready and willing to repay the entire amount to the complainant, provided some time is given to him. The counsel for the complainant is also present, and he state that he is ready to take the offer. Let the necessary statement be made before the Investigating Officer.

The application is disposed off.
