There is no case made out for varying the order dated 07/09/2015 insofar as the quantum of deposit is concerned. In fact, the arrears in terms of the impugned order are more than Rs.7,00,000/-. However, considering the circumstances presented before this Court, a direction was issued to deposit amount of Rs.3,50,000/- on or before 01/10/2015 and on the said basis, execution of the distress warrant was stayed. There is no case made out for seeking reduction of this amount, particularly now that the petitioner has availed the benefit of stay order right from 07/09/2015.

However, by way of indulgence, time for deposit of the amount is extended as and by way of last and final opportunity up to 19/10/2015. In case the amount is not deposited on or before 19/10/2015, the stay order granted on 07/09/2015 shall stand vacated, without any further reference to this Court. 4.
Place this matter on 21/10/2015 (on Supplementary Board).
