Learned counsel for the Appellant states that the appropriate remedy would be to approach the Sessions Court under section 372 of the Criminal Procedure Code and not the High Court. He seeks liberty to withdraw this Appeal with liberty to approach the Sessions Court.

Learned counsel for the Respondents do not have any objection if the Appeal is allowed to be withdrawn with such liberty.

Therefore, the Appeal is allowed to be withdrawn with liberty to approach Sessions Court with proper proceedings. If any such proceedings are initiated, they shall be decided in accordance with law.
