Heard the learned counsel for the applicant and the learned APP.
The applicant is apprehending his arrest in connection with C.R. No. 0819 of 2022, which invoke sections 313, 354, 323, 504, 506, r/w section 34 of IPC.

The complainant reported to the police station that on 18/04/2022, somebody was hurling abuses outside her door and when she opened the door, she could find her neighbour Yasmeen Khan present there. When her husband questioned Yasmeen, why she is abusive, she even hurled abuses at him.

2/2 907 ABA 2659.22.doc At 21:30 hours in the night when her husband left for the job and she was all alone at home, her door was again knocked and she found Yasmeen Khan, Alam Khan, and Jugnu alias Sahil Khan i.e. the present applicant outside her door. They abused her and Yasmeen pulled her by catching her hair and it is specifically alleged that the present applicant kicked her in her abdomen, as a result of which she started bleeding.

The said incident is witnessed by one Smt. Kamla Ashok Choudhary, who also corroborate the complaint. Though I have released Yaseem and Alam the co-accused on bail in anticipation of their arrest, in the wake of the specific role attributed to the applicant and ultimately his act resulted in aborting her pregnancy, invoking offence under section 313 of IPC, the custodial interrogation of the applicant is very much necessary. For the reasons recorded above, the application is rejected. ( SMT. BHARATI DANGRE, J.) Ashish Mhaske
