Learned counsel for the applicant states that a condition is imposed while releasing the applicant on bail that he shall not directly or indirectly establish any contact with the victim or with the complainant. He states that since the divorce proceedings are pending in the court at Ujjain, where there is a AJN

2/2 20 IA-2964.21.odt possibility of conciliation/mediation being effected, he apprehends that, that would be alleged as a breach of condition. 2.

Needless to state that the mediation in a matrimonial discord will bring the husband and wife in a common platform, where the victim is also required to participate. Thus, such meetings cannot be considered as a breach of condition on part of the applicant to establish contact.

With the aforesaid clarification, the interim application is disposed off.
