The order impugned in this petition is an order of final assessment passed under section 126 of the Electricity Act, 2003. A remedy of an appeal is available to the petitioner under the provisions of Section 127 of the Electricity Act, 2003 to challenge the said order.

In the facts of the case, it is appropriate that the petitioner espouses the alternate remedy available to it under law. The petition is, accordingly, disposed of permitting the petitioner to file an appeal, which be filed within a period of two weeks from today. 4.

All contentions are expressly kept open.
