1] This is an application for relaxation of condition No.(iii) imposed upon the applicant at the time of releasing him on bail by this Court by its order dated 3rd February 2017.

The said condition reads as under :- "Applicants shall not reside at Boisar till the framing of charge."

osk 36-appp-865-2017.odt 2] The learned counsel for the applicant submitted that, the applicant is an agriculturist and due to the said condition, his day-today activities have come to halt. He further submitted that, in the last two years the prosecution has not even bothered to proceed with the matter to frame charge against the applicant.

3] In view of the submission made by the learned counsel for the applicant and the fact that the prosecution has not proceeded with the matter to frame charge against the applicant till date, the present applicant is allowed and the said condition No.(iii) is waived with immediate effect.
