Heard learned counsel for applicant and learned APP for some time.

When this Court was not inclined to granted any relief, learned counsel for applicant submitted that this Court (Coram : Sandeep K. Shinde, J.) by order dated 2nd September 2021, had requested the trial Court to expedite the trial. The said order was passed on 2nd September 2021 but yet charge has not been framed. Applicant is behind the bar for more than 4 years. Shubhada S Kadam 30-ba-3736-2022.doc hence, bail application of the applicant be considered. In the alternative, he submitted that direction be given to the trial Court to conclude the trial as early as possible preferably within six months and applicant be allowed to withdraw the application. 3.
Learned APP submitted that applicant is the main accused who gave stab injury to deceased and this Court while passing order has observed all these facts. Learned APP submitted that if trial Court is directed to conclude the trial within one year and six months, it would suffice.

Considering the submissions of both learned counsel, application is allowed to be withdrawn and same is disposed off. 5.
As the applicant is behind bar for more than four years, the trial Court is requested to conclude the trial as early as possible preferably within one year and six months after receipt of this order. (SHIVKUMAR DIGE, J.) 2/2
