Heard learned counsel for the applicant and learned APP for the State.

This is an application filed for suspension of substantive sentence and for bail.

Learned counsel for the applicant had contended that applicant was on bail pending trial, and though applicant who was charge-sheeted for the offences punishable u/s.306, 323, 417, 494 and 506 IPC has been convicted for the offence u/s.417 IPC and is sentenced to suffer RI for 1 year and u/s.494 of IPC and is sentenced to suffer RI for six years. It is also contended that offence u/s.494 IPC is bailable.

Tilak 2/2 (17)APPA-1197-16 Record reveals that applicant came to be convicted as aforesaid, for the offences stated as above. Applicant, admittedly, was on bail, pending trial.

Considering the nature of punishment imposed as aforesaid, and sine applicant was on bail pending trial, following order is passed.

O R D E R

(i) Applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.20,000/- with one surety in like amount.

(ii) On being released on bail, applicant shall mark his presence with Turbhe MIDC Police Station once in six months on first day of each such month.

(iii) Applicant shall provide proof of his residential address, and shall update the same with the Investigating Officer if there is change in his residence in future.
