This civil application is filed by the wife of the deceased for withdrawal of the amount deposited by the appellant insurance company. This is a fatal accident. The learned Counsel for the applicant has submitted that till today, no amount is received by the applicant and she has incurred expenses. She further submitted that the applicant is a widow and she has a minor daughter and they have no source of income. 2.

In view of the above, the applicant is allowed to withdraw a sum of Rs.8 lakhs out of the total deposited amount of Rs.16,62,872/- on a usual 1 / 2

caf.3979.2015_30.doc undertaking to be furnished by the applicant. Balance amount shall be invested in a fixed deposit of any nationalised bank. 4.

Civil Application is disposed of accordingly. 5.
