These applications under Section 438 of Cr.P.C. are filed by the aforesaid Applicants apprehending their arrest in Crime No. 1232 of 2021 registered with Sangola Police Station, Solapur, for the offences under Section 272, 273, 420, 328 r/w. 34 of Indian Penal Code, Section 26(1), 26(2), 26(2)(v), 27(3)(e), 30(2)(a), 38(6) and 59 of the Food Safety and Standard Act, 2006. 2.
The aforesaid crime was registered pursuant to the FIR lodged by the Food and Drugs Inspector. The case of the prosecution is that the shop by name Vithai Milk and Food Products was raided. The Applicants in BA/2736/2021, BA/2738/2021, BA/2740/2021 and BA/2755/2021 are the partners of the said shop. It is alleged
that these Applicants were found adulterating cow milk and Buffalo milk. Whereas, the Applicant in ABA/2810/2021 has allegedly sold Whey powder of Amul brand to the partners of the said shop. The articles used for adulteration were seized. 3.
The Applicants were granted pre-arrest bail on 8.11.2021. It is stated that the Applicants have reported to the Investigating Officer. They have been interrogated and upon completion of investigation chargesheet has been filed. Presence of the Applicants is no longer required for the purpose of interrogation. Hence the Applications are allowed on the following terms and conditions:- (i) In the event of arrest of the Applicants in Crime No. 1232 of 2021 registered with Sangola Police Station, Solapur, the Applicants be released on bail on furnishing P.R. bond of Rs.20,000/- (Rupees Twenty Thousand Only) each, with one or two sureties in the like amount.
(ii) The Applicants shall not interfere with the complainant and the other witnesses in any manner.
(iii) The Applicants shall provide their permanent as well as
temporary address, if any, and their contact details to the Investigating Officer.
(iv) The Applicants shall not change their residential address without prior intimation to the Investigation Officer. (ANUJA PRABHUDESSAI, J.)
