It is not in dispute that the issue raised in the Petition would be covered by the judgment of the Division Bench of this Court (Aurangabad Bench) in Writ Petition No. 6291 of 2010 dated 18.10.2010 (Vijay S/o. Pandharinath Aradwad & Anr. Vs. The State of Maharashtra & Ors.). 2.

In the circumstances, for the reasons stated in the aforesaid order dated 18.10.2010, the impugned communication dated 10.10.2017 is quashed and set aside. The Respondent Nos.2 & 3 are directed to issue the Certificate of Project Affected Persons to the Petitioner within eight weeks from today.

The Petition is allowed in the above terms.
