The record discloses that the respondent Nos.1 and 2 are served. Despite that, none appeared on their behalf. The appellant by making averments in this application has explained the delay. Since the respondent Nos.1 and 2 have not put their appearance, they deemed to have accepted these averments. We accordingly allow the Nesarikar
