CORAM : REVATI MOHITE DERE & R.N.LADDHA, JJ.

DATE : 30 NOVEMBER, 2022.

P.C. :

1.

This is an application seeking quashing of the proceeding with the consent of the respondent no.2 (complainant), in view of the amicable settlement between the applicant and the respondent no.2. Since the applicants have only settled with the respondent no.2 (original complainant), we are not inclined to allow the petition seeking quashing of proceeding by consent.

2.

Accordingly, learned Counsel for the applicants seeks leave to withdraw the petition. The petition is, accordingly, dismissed as withdrawn.

3.

In view of dismissal of the application, nothing survives for consideration in Interim Application (Stamp) Nos.17855 of 2022 and 2/3

17856 of 2022. Hence, both the interim applications stands disposed of.

4.

All contentions of the applicants on merits are kept open. 5.

We make it clear that we have not heard this application on merits.

6.

All parties are to act on authenticated copy of this order. R.N.LADDHA, J.
