The applicant is seeking pre-arrest bail in M. E. Crime No.10 of 2016 for the offence punishable under Sections 420, 406 r/w 34 of the Indian Penal Code.

It is the case of prosecution that, the applicant herein is the Director of one Safalta Ornaments, who had given certain cheques towards consideration of the ornaments purchased. It is claimed that the firm has duped the complainant, resulting into registration of the crime.

Perused the F.I.R. From the F.I.R. it reflects that the applicant's name is only referred to, but for any specific attribution
ssk 2/2 Cri. ABA 1684/16-18/11/16 against him. There are specific attributions against the another Director Hemang Shukla.

In absence of any specific attributions against the present applicant as regards the active participation in the commission of crime in question, in my opinion the applicant as a Director of the Company can't be held responsible. In view thereof the application needs to be allowed. In the event of arrest, the applicant be released on furnishing P. R. Bond of Rs.50,000/- with two sureties in the like amount on following conditions : (i) The applicant shall furnish his mobile phone numbers and permanent place of abode to the Investigating Officer within one week from today.
(ii) He shall attend the Investigating Officer on Monday and Thursday for two consecutive weeks and thereafter as and when called for.
(iii) He shall not tamper the evidence and/or influence the witnesses.
