IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO.566 OF 2016 Vishaya Mukesh Sondkar ...

Applicant V/s.

Mr. Amit Pramod Salunkhe and anr.

...

Respondents ----- Ms. Krupali Hiren Rajani, Advocate for the Applicant. Mr.M.K.Kocharekar, Advocate for Respondent No.1. Mrs.N.S.Jain, APP for Respondent No.2.

----- CORAM : A.M.BADAR J.

DATED : 22nd AUGUST 2017.

P.C. :

1.

This is an application for condonation of delay of 31 days in filing an application for leave to appeal.

2.

Heard the learned Advocate appearing for the Applicant as well as the learned Advocate appearing for Respondent No.1. APP appears for Respondent No. 2.

3.

The learned Advocate appearing for Respondent No. 1 vehemently opposing the application by contending that there is no justifiable reason for condoning delay of 31 days. However, it is seen that the application is cogently explaining the reason for delay of 31 days. Averments therein are not countered by filing counter affidavit. As the application is disclosing sufficient cause, the delay is condoned. The application is accordingly disposed of. (A.M.BADAR J.) ......
