The learned counsel for the applicant submits that it is not necessary to serve the respondent nos. 3 and 4. At the cost and consequences of the applicant, same is accepted.

This Application is preferred by the Insurance Company for condonation of 107 days delay in filing First Appeal challenging the Award dated 18.02.2014 passed by the M.A.C.T. Mumbai in Petition no. 1272 of 2009.

7 caf 3514-14=.doc learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Delay of 107 days in filing First Appeal challenging the Award dated 18.02.2014 passed by the M.A.C.T. Mumbai in Petition no. 1272 of 2009, is condoned.

b) Civil application stands disposed off accordingly.
