Heard learned counsel for parties 2.

By this application u/s 24 of C.P.C., applicant/wife is seeking transfer of Marriage Petition No.178/2018, filed by respondent/husband u/s 13(1)(ia) of Hindu Marriage Act, for divorce before Civil Judge Senior Division, Thane to Civil Judge, Senior division, Satara.

In first session, both the counsel argued the matter. At their request, matter was kept in the second session. 4.

In second session, learned counsel for respondent no.1 submits that he received instructions by e-mail from his Chitra Sonawane 1

client, stating that he want to withdraw Marriage petition filed by him before Laerned Civil Judge, at Thane. Same is taken on record and marked as "X" for identification. 5.

Hence, the following order.

A) Respondent/husband is directed to comply statement made by him before this court that he wants to withdraw the Marriage Petition No.178/2018, filed before Civil Judge Senior Division, Thane within two months from today with intimation to other side.

b) In view of subsequent development that husband want to withdraw the Marriage petition No.178.2018, nothing survives in this application. c) Hence, miscellaneous civil application is dismissed as infructuous.

d) No order as to cost.
