Shri Prashant Raul i/b Shri Kalpesh U. Patil for the Applicant. Shri Saurabh D. Butala for the Petitioner.

Dr. F.R. Shaikh, APP for the Respondent State. - CORAM :

A.S. OKA & A.A.SAYED, JJ DATED :

31ST AUGUST 2016 P.C.:

.

The learned counsel appearing for the Applicant seeks time. This is an Application filed by the second Respondent in Criminal Writ Petition. In the said Writ Petition, Rule was issued on 17th December 2013 and the Rule on interim relief was made returnable on 12th February 2014 while granting the ad-interim relief. The prayer in this Application is for vacating the order issuing Rule. The Applicant was not entitled to be heard at the

ash apl-426.15 stage of admission as the matter of admission is between the Court and the Petitioner. The prayer is misconceived. Interim relief has not been granted in the main Writ Petition. What is granted is the adinterim relief. Hence, both the prayers are misconceived and accordingly the Application is rejected.

2.

Place the main Writ Petition for hearing as to interim relief on 30th September 2016.
