Heard learned counsel for the applicant and learned APP appearing for the State. None appeared on behalf of the respondent Nos. 2 and 3 though served. The application is taken out for condonation of delay of 47 days occurred in filing the aforesaid leave to appeal.

By making averments in paragraph 3, the applicant has explained the delay. We find the explanation to be satisfactory and, therefore, we condone the said delay of 47 days. The criminal application is, accordingly, allowed in terms of prayer clause (a) and is disposed off as such.
