This is an application for anticipatory bail in connection with CR No. I-398 of 2018 registered with Mumbra Police Station. By order dated 5th September, 2018, applicant was granted interim protection. Learned counsel for the applicant submits that so far, the applicant has deposited an amount of Rs.3,00,000/- and balance amount is Rs.10,65,000/-. Applicant has impleaded the complainant and other aggrieved persons as respondent in this application.

It is submitted that as pointed out in the First Information Report, there was no liability as against the Respondent No.5. As
far as Respondent No.2, 3 and 4 are concerned, applicant is paying the balance dues by way of demand draft. Respondent No.2 is represented by the learned counsel Mr. S.M.Gaikwad. He has identified the complainant. Complainant is present in the Court. Respondent No.3 and 4 are also present in the court and they are identified by the Investigating Officer. Learned counsel for the applicant has handed over Demand Draft issued in favour of Respondent No.2 in the sum of Rs.5,15,000/- to the learned counsel representing the Respondent No.2. The same is handed over to the Respondent No.2. Demand draft in the sum of Rs.2,00,000/- issued in favour of Respondent No.3 is also handed over to the Respondent No.3 and demand draft in the sum of Rs.3,50,000/- issued in favour of Respondent No.4 is also handed over to the said respondent No.4.

The case of the prosecution is that the applicant had represented the victim that the job would be provided to them and had accepted the amount from them. Applicant is government servant and in case of his arrest, her employment would be jeopardised. Considering the fact that payments as aforesaid is made to the victims, interim order dated 5th September, 2018 deserves to be confirmed.
ORDER
i.
Anticipatory Bail Application No. 1792 of 2018 is allowed; ii.
Interim order dated 5th September, 2018 stands confirmed; iii.
In the event of arrest of applicant in connection with CR No. I-398 of 2018 registered with Mumbra Police Station, Thane, the applicant be released on bail on furnishing P.R Bond in the sum of Rs.15,000/- with one or more sureties in the like amount; iv.
Application stands disposed off.
