The petitioner's grievance is that in adjacent area, unauthorised construction is going on and the premises occupied by the petitioner is being used by the neighbourers. In spite of repeated request, respondents are not taking any action. 2.

In the facts, we observe that the petitioner may resort to appropriate alternate remedy as questions of facts need to be determined by leading evidence.
