Heard the learned Counsel for the parties.

At the outset the learned APP submits that the trial has commenced and three witnesses have already been examined. Though the prosecution has cited 11 witnesses, yet the prosecution may examine four more witnesses. 3.

In view of the aforesaid statement, the learned Counsel for the applicant, on instructions, seeks leave to withdraw the application.

The learned Counsel further submits that since the trial has already commenced and the applicant has been in custody since January, 2022, the trial be expedited. 5.

The submission appears justifiable.

The learned Special Judge seized with Special Case No.755 of 2022 arising out of CR No.3 of 2022, is requested to make an endeavour to conclude the trial as expeditiously as possible and, preferably, within a period of nine months from the date of communication of this order.
