In pursuance of order dated 6th October 2015 the notice was issued to the respondent no.2 i.e. the original complainant-wife. Today Mr. Manoj Chatage, the learned Counsel for the said respondent no.2 appears and undertakes to file his vakalatanama during the course of the day. The learned Counsel for the respondent no.2 has tendered the affidavit of the respondent no.2 in the Court. In the said affidavit, the respondent no.2 has stated that she married with the applicant as per Hindu Vedic rites on 17.7.2015 at Arya Samaj Goregaon, Mumbai. She has further stated that she had lodged the present complaint before the Borivali Police
2/2 aba.1466-2015 Station bearing CR No.433 of 2015 against the applicant out of misunderstanding and she wish to withdraw her complaint and all the allegations made against the applicant (husband). The said affidavit dated 17.11.2015 is taken on record and marked "X" for identification. In view of the affidavit filed by the respondent no.2 dated 17.11.2015, the interim protection granted to the applicant by an order dated 9.10.2015 is hereby confirmed, with a modification that the applicant shall not be called to the police station for the purpose of investigation hereinafter. Needless to mention that in view of the affidavit filed by the respondent no.2-wife, the Investigating Agency shall not precipitate the matter any further and shall take note of the aforesaid.
