None appears for the Applicant. The prayer in this Application under Section 482 of the Code of Criminal Procedure, 1973 is for quashing the proceedings of the special case pending in the Court of the learned Special Judge at Mumbai. It is pointed by the learned counsel appearing for the first Respondent that by an order dated 28th June 2011, the Application filed by the Applicant for discharge has been rejected by the learned Special Judge by a detailed judgment and order. It is also pointed out

ash apl-965.13 that the said judgment and order was confirmed by this Court by the judgment and order dated 24th August 2011 in the Criminal Revision Application No.365 of 2011. The Applicant has filed a Special Leave Petition before the Apex Court for challenging the judgment and order dated 24th August 2011. The order dated 21st November 2011 shows that the said Special Leave Petition was dismissed.

We must note here that in the present Application which is filed on 19th September 2013, copies of the aforesaid orders have not been annexed.

In view of the order of confirmation of the order dismissing the Application for discharge, we decline to entertain this Application under Section 482 of the Code of Criminal Procedure, 1973. The Application is rejected.
