The present Criminal Writ Petition is filed by the Petitioner in September 2016 thereby praying for quashing of the summons issued on a complaint filed under Section 12 of the Protection of Women from the Domestic Violence Act, 2005.

This Court had issued notice on 05.10.2016 and made it returnable on 26.10.2016. From the said date, no attempt had been made by the Petitioner either to serve to the Respondents or to take any steps to get the matter be listed and to be argued. Since the summons were issued long back in July 2016, the matter before the Court of Judicial Magistrate First Class, Vasai must have proceeded ahead.
