It is seen that the applicant has committed a breach of the terms and conditions imposed upon him at the time of directing the suspension of sentence imposed upon him. It also appears that he was absconding for quite sometime. avk 1/2

10-APPA-1371-2014.doc Under the circumstances, the order suspending the substantive sentence imposed upon the applicant is revoked. The bail granted to the applicant stands cancelled. The applicant is taken in custody and be forwarded to the prison to undergo the remaining part of his sentence. The application is disposed of accordingly.

However, in view of the submission made by the applicant, that, he is ready to compound the offence, and that, the concerned officials of the BEST have agreed for such compounding of the offence, liberty is granted to the applicant to make a fresh application seeking composition of the offence, after giving notice to the BEST.
