Applicant is Accused no.6 in Sessions Case No. 56/2018 arising from Crime No.149/2017 for alleged offences punishable under Section 302, 120(b) r/w 34 of the Indian Penal Code, 1860. Accused no.1 is father and accused no.2 to 5 are brothers of the applicant. Deceased is cousin of the applicant.

It is alleged, on 06.10.2017, the accused in execution of conspiracy murdered Shadab.

I have perused the charge-sheet. The alleged incident of murder is witnessed by Mehtab Alam and the complainant. I have no reason to disbelieve eye witness. Besides, the test identification parade was held on 18.11.2017 wherein applicant is identified. 6.
