DATED:- 10th OCTOBER, 2023 PC:- 1) Heard the learned Counsel for the applicant and the learned APP for the State.
2) By an order dated 5th September, 2023, this Court has granted interim bail ascribing reasons. Pursuant to the aforesaid order, the applicant has appeared before the Investigating Officer, as directed.
3) The learned Counsel for the applicant invites the attention of the Court to the order dated 7th May, 2021, whereby the co1/3
accused Aslam Shaikh was granted pre-arrest bail. This Court was persuaded to grant pre-arrest bail to the co-accused, having regard to the fact that the custodial interrogation of the said coaccused was not warranted to facilitate investigation. 4) The learned APP submitted that the stamp paper on which the allegedly forged bank guarantee has been scribed appears to have been purchased in the name of the applicant. 5) Prima facie, it does not appear that the applicant was the purported beneficiary of the bank guarantee or at the instance of the applicant the said bank guarantee was furnished. The coaccused, against whom the first informant primarily entertained the suspension, has been granted pre-arrest bail. The applicant also deserves the same dispensation.
6) Thus, order of Interim Bail dated 5th September, 2023 is made absolute on the terms and conditions incorporated therein.
7) The applicant shall henceforth appear before the Investigating Officer as and when directed.
8) The applicant shall regularly attend the proceedings before the jurisdictional Court.
9) The application stands disposed.
