These writ petitions challenge an interim order passed by the Labour Court at Sangli on an application made to it under Section 30(2) of Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971 (Exhibit U-2) and the revisional order passed by the Industrial Court at Sangli confirming that order. The interim order sought was for maintaining status quo in respect of employment of the Petitioner (original complainant). Since there was no interim relief, the Respondent employer has gone ahead and terminated services of the complainant. On these facts, the challenge

17. WP 11648-18.doc has really become infructuous. Accordingly, the petitions are disposed of as infructuous. The Labourt Court at Sangli is, however, requested to dispose of the original complaint filed by the Petitioner as expeditiously as possible. The Petitioner will be entitled to amend his complaint by challenging inter alia his termination. As and when such application is made, the same shall be decided by the Labour Court on its own merits. All rights and contentions of the parties in that behalf are kept open.
