1] In pursuance of Order dated 30th August 2019, Mr.Manohar More, Assistant Registrar, Co-Operative Societies, Mahad, District : Raigad, has filed an Affidavit-in-Reply dated 27th August 2019 placing on record a 'Notification' dated 25th February 2011 passed by the Principal Secretary (Housing) under the provisions of The Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963, (for short, "said Act"). 1/2

osk 7-wp-10232-2014.odt 2] In the schedule appended to the said Notification at Sr.No.6, the designated Authority who has passed the impugned Order dated 23rd July 2014 herein, has been notified as competent Authority to decide applications preferred under Sections 10 and 11 of the said Act. 3] In view of the said affidavit and Notification dated 25th February 2011, the challenge to the present Petition does not survive and the Petition is accordingly dismissed in limine.
