Heard learned counsel for the parties.

By this Application, the Applicant seeks Transit Anticipatory Bail for a period of three weeks, in connection with an offence punishable under Section 138 of Negotiable Instruments Act, to enable the Applicant to take appropriate steps and approach the competent Court of law i.e. District and Session Court at Nainital, Uttarakhand, within the said period, for getting his NBW cancelled.

Accordingly, the Application is allowed. The Applicant is granted transit anticipatory bail for a period of three weeks i. e. the
2/2 923-aba.1893.2019..doc Applicant shall not be arrested for three weeks from today to enable him to approach the appropriate Court for seeking appropriate reliefs, on the following terms & conditions :-
O R D E R
(i) In the event of the Applicant's arrest in connection with an offence punishable under Section 138 of Negotiable Instruments, the Applicant be enlarged on transit anticipatory bail, for a period of three weeks from today, on executing P. R. Bond in the sum of Rs. 10,000/-, with one or two sureties in the like amount; (ii) During this period, the Applicant shall approach the appropriate Court and seek necessary orders.

It is made clear, that this Court has not considered this Application on merits.

The Application is accordingly disposed of.
