Learned counsel appearing for the applicant states that the respondent no.1 who is contesting party has been served. By this civil application, the applicant seeks condonation of delay in filing this civil application and for restoration of the second appeal which is dismissed in view of the conditional order passed by this court on 10th November, 2014.

Learned counsel appearing for the applicant has agreed to file photocopy of the paper-book in Regular Civil Appeal NO.228 of 2006 in this court within two weeks from today.

For the reasons recorded in the civil application, civil application is made absolute in terms of prayer clause (a) on the condition the applicant complies with the order passed by this court on 10th November, 2014 within two weeks from
