This is an application for cancellation of bail. Respondent no.2 was granted bail by the Sessions Court in connection with C.R.No.125 of 2016, registered with Kanjurmarg Police Station, Mumbai, for the ofence punishable under Section 306 of IPC.
The applicant is the original complainant. Learned advocate for the applicant submitted that the victim had committed suicide. The Court had not considered the aspect that the victim was forced to transfer the room in the name of the
rpa 2/2 22 appln 570 2016.doc daughter of the accused. The suicide note was found during the investigation. The ofence is of serious nature. The trial has commenced and one witness has been examined. However, considering the seriousness of the case, bail may be cancelled. Respondent no.2 was arrested in connection with the aforesaid ofence. FIR was lodged on 12th August, 2016. It is alleged that the victim was forced to transfer the room in the name of the daughter of respondent no.2. Learned Sessions Judge, while granting bail has considered that the applicant was in judicial custody, further detention is not necessary. It is also pertinent to note that the trial has already commenced. Bail was granted on certain conditions. Considering the factual aspects of the case, no ground is made out to cancel the bail granted to the respondents vide order dated 6th September, 2016. :: O R D E R ::
(i) Criminal Application No.570 of 2016, is rejected, and, disposed of accordingly.
