This Application is moved for condonation of delay of 377 days in filing the First Appeal. The Appeal is filed against the judgment and order dated 15th October, 2008 passed by the Additional Commissioner for Workmen's Compensation & Judge, 7th Labour Court, Mumbai 2.

The learned counsel for the applicant submitted that the appellant was injured and suffered 35% permanent disability and therefore, he could not file Appeal within time. 3.

The learned counsel for the respondent no. 2/insurance company opposed the Application.

In view of the reasons mentioned in the Application and the submissions of the learned counsel for the applicant, delay of 377 days is condoned.
