This is an Application for bail. The Applicant has been chargesheeted for the offence punishable under Section 370(A)(2) of IPC and Section 3, 4, 5 and 6 of the Immoral Traffic (Prevention) Act, 1956, arising out of Crime No.405/2021 of Police Station Vijapur Naka, Solapur City.

The prosecution case is that the Applicant was running a brothel at her house, where on prior information, a raid was conducted by sending a decoy customer in which two victim girls, aged about 25 to 30 years were found and in the investigation, it was Mamta Kale page 1 of 3

disclosed that both the girls were called by the Applicant for purposes of prostitution.

I have heard the learned counsel for the parties. Perused record.

The investigation in this case is complete and the chargesheet is filed. There is no recovery to be made. The Applicant is arrested in August 2021 and is in jail since then.

Learned counsel for the Applicant submitted that there are no criminal antecedents to the discredit of the Applicant of indulging in similar offence previously.

Considering the over all circumstances, the following order is passed.

ORDER

(i) The Applicant be released on bail in Crime No. 405/2021 of Police Station Vijapur Naka, Solapur City, on her executing a P.R. Bond in the sum of Rs.25,000/- with one or two solvent sureties, in the like amount.

(ii) The Applicant shall undertake to remain present during the course of trial.

(iii) The Applicant shall not directly or indirectly make any attempt to contact the victim or any other prosecution witnesses and shall not otherwise tamper with the prosecution evidence.

(iv) The Applicant shall not allow the house to be used for any similar activities.

(v) In the event of breach of any of the conditions, the bail is liable to be cancelled.

(vi) Bail before the learned Sessions Judge.
