The learned Senior Counsel appearing for the applicant, upon instructions, submits that the applicant would appear before the Court of Sessions at Niphad on or before 10.10.2016.

Without going into the merits of the matter, the applicant stands protected till 5 p.m. on 10.10.2016. The learned Sessions Judge shall decide the application on its own merits, without being influenced by the withdrawal of the present application as this Court has not gone into the merits of the matter. The learned Sessions Court shall make an endeavour to decide the application, as far as possible by 7.10.2016.

The applicant shall give notice to Saikheda Police Station, Taluka Niphad as also to the Prosecutor before causing his appearance before the Sessions Court.
