It is not in dispute that respondent No.1 Haresh is no more and hence matter abated against him.

Advocate Tapan Thatte waived notice for respondent Nos.2 and 3. Learned APP waives notice for respondent No.4. 5.

Respondent Nos.2 and 3 to file their personal undertaking in the sum of Rs.20,000/- each for their appearance on due dates during pendency of this appeal before this Court. Similarly, they shall also furnish one surety in like amount for this purpose.

They shall place on record affidavits mentioning therein the addresses at which they shall be always available with their contact numbers.

Similar details in relation to surety shall also be furnished. 8.

During the pendency of proceeding before this Court, they shall report on 1st Monday after every three months to the D. N. Nagar Police Station to mark their attendance.

Undertakings in the above line shall be filed within four weeks on record of present proceeding separately by both respondent Nos.2 and 3. 10.

Failure to comply with terms and conditions shall entitle the respondent No.4 to take them in custody.
