Heard learned Counsel for the parties.
By this Civil Application, Applicant is seeking to delete the name of Respondent No.2 Madhavlal Narayanlal Pittie from the cause title of First Appeal and to join Mr.
Vivek Madhavlal Pittie as Respondent No.2(a) in the First Appeal and pending Civil Applications.
At this stage, the learned counsel for the Respondent submits that they have no objection if the Civil Application is allowed in terms of prayer clauses (a) and (b). He further submits that he undertakes to file Sneha Chavan 1/2
20 caf 326-19=.odt vakalatnama on behalf of newly added Respondent. Statement is accepted.
By consent of both the parties, following order is passed:
a) Civil Application is allowed in terms of prayer clauses (a) and (b), which reads, thus:
"(a) The name of Respondent no.2 i.e.
Madhavlal Narayanlal Pittie may be permitted to be deleted in the First Appeal and Civil Applications.
(b) Mr. Vivek Madhavlal Pittie, Respondent may be joined as Respondent No.2(a) in the above First Appeal and Civil Applications."
b) Amendment to be carried out on or before 16.11.2019 with copy to other side.
c) In view of statement made by the learned Counsel for the Respondent No.2 that they are ready to file vakalatnama on behalf of added Respondent, there is no question of issuing fresh notice to the newly added Respondent.
